You need a strong attorney behind you to make sure you protect your assets and get a fair judgement. Although not always successful, a good attorney should be able to convince the other side that a deal be made to allow the cop to protect his/her entire pension. Doing so is admore advantageous to both parties than a full blow trial which could cost in excess of $40,000 in legal fees. Naturally the cop gives up certain claims to marital property. Child support is by statute, no matter what any person states, the Courts must follow the statute (exceptions can however be made under certain circumstances, and parties can “opt out” of the child support statute as well).
